Advertisement Policy

1. Overview

Registered Users are entitled to post a professional AI-related ad on the AI Marketplaces of web page https://ai-hungary.com/ under the terms and conditions contained in this policy. By posting this ad, User represents that he/she has become familiar with the provisions of this policy and accepts them as binding.

2. Ad content

By accepting this policy, User acknowledges that only those ads closely related to Artificial Intelligence may be posted that comply with the classification as indicated on the AI Marketplaces platform of https://ai-hungary.com/ (technologies, data, education, funds, research projects, consultancy, jobs); with regard to any other content the operator of the AI Hungary web page retains the right to reject the advertisement request.

3. Forbidden content

1. Community principles
Ads may not violate the following principles: authenticity, security, data protection, dignity.

2. Illegal products and services
Ads may not embody, support, or promote illegal products, services, or activities. They further may not promote products, services or content that are problematic, not legal, not secure, or are misleading.

3. Discriminative practice
Ads displayed on the AI Marketplaces may not apply or encourage discrimination against individuals based on personal features, e.g. race, ethnicity, nationality, color, religion, age, sex, sexual orientation, gender-based identity, marital status, disability, state of health or genetics.

Ads displayed on the AI Marketplaces may not feature content that breaches the rights of any third parties (e.g. copy rights, trademarks, data protection rights or any other personal or property rights.)

Ads displayed on the AI Marketplaces may not feature statements, or any references thereto, concerning personal characteristic features, including race, ethnic origin, religion, faith, age, sexual orientation or practices, gender-based identity, disability, state of health (more specifically physical or mental health), financial situation, union membership, criminal records, or any direct or indirect statements or references with regard to their name.

4. Disturbing, low quality, click-bait content
Ads displayed on the AI Marketplaces may not feature any contents that redirect the users to external landing pages giving an unexpected or disturbing experience. This includes misleading placement of ads as well, for instance, using click-bait or shocking headlines, call-to-action of users to interact in an non-authentic way, or redirecting users to landing pages where only a minimum amount of original content and mostly non-related or low-quality advertisement contents are found. Furthermore, no disrespectful or violent content may be displayed.

Characteristic features of low-quality advertisement content:
• Text in ad images: Text-heavy ad images and video thumbnails. If the ad image or the video thumbnail is text-heavy, the ad will not be published.
• Retaining information: Ads retaining information with the purpose to promise to reveal the full context of the topic whilst encouraging people to click on a link.
• Click-bait language: This includes the use of exaggerating headlines, or those that provoke you to react, which are bound to lead to unexpected user experience in case they click on the landing page.
• Activity hunting: If an ad incentivizes you react by using spam content to get more likes, comments or shares in this discredited way.
• Adult content
• Error landing page
• Low-quality, contradictory or disturbing content

5. Misinformation
All ads are forbidden by web page AI Hungary that contain statements that have been denied by external fact checkers or, in certain cases, by other organizations specialized for a given area. We may limit advertising activity for advertisers that post information, which has been repeatedly identified as false.

6. Controversial content
Ads displayed on the AI Marketplaces may not feature any content that use crisis situations or controversial political or social matters for business purposes.

7. Error landing page
Ads displayed on the AI Marketplaces may not direct you to error landing pages. This includes landing pages that limit visitors to leave the page.

8. Fraudulent and misleading practices
Ads displayed on the AI Marketplaces may not promote products or services of which purpose is to allow users to conduct fraudulent and misleading practices.

9. Language
Ads displayed on the AI Marketplaces may not feature adult language, nor grammatical or spelling errors. Symbols, numbers, and letters must be used correctly, without the intention to trick our ad checking process and our other protocols meant for enforcing rules.

10. Non-existent functionality deceiving statements
Ads displayed on the AI Marketplaces may not feature images depicting non-existent functionality. This includes images replicating play buttons, notifications or checkboxes, and ads that contain non-operating functions, e.g. multiple choice answers, as part of the creative content of the ad.
Ads displayed on the AI Marketplaces may not feature deceptive, false or misleading statements, among others with regard to the effectiveness or characteristic features of any given product service, nor such statements that trigger unrealistic user expectations, e.g. concerning health, job opportunities or weight loss.

11. Spyware or malware
Ads may not feature spyware, malware or any other software that triggers unexpected or misleading experience, including links to pages containing such products.

12. Unacceptable business practices
Ads may not promote products, services, constructions or offers conducting deceptive or misleading practices, including those that are meant to evade money or personal records.

13. Circumventing protocols
Ads may not apply methods of which purpose is to trick or circumvent our ad checking processes or our other protocols meant for enforcing rules. This includes methods that try to disguise the content or target page of the ad.

14. Forbidden financial products and services
Ads may not promote financial products or services which are often associated with misleading or fraudulent advertising practices.

15. Content not complying with laws and
Advertiser acknowledges that beyond the above all ads may not be posted, or can be rejected, that breach the law or the provisions of the Hungarian Advertising Ethical Code, the relevant industrial codes, in particular the Content Regulation Code of Conduct of the Association of Hungarian Content Providers.

4. Terms on PR articles
Under Act 2008 of XLVIII on the basic conditions and certain limitations of economic advertising activity, Act 2008 of XLVII on the ban of unfair anti-consumer trade practices and Act 2010 CLXXXV on media services and mass communications, Act 2010 of CIV on press freedom and the basic rules of media contents and the Hungarian Code of Advertisement Ethics PR articles must be published in a way that specifically reveals the nature of the advertisement. Operator of AI Hungary indicates such a piece by using ‘ADVERTISEMENT’ title, or in an identical way, to clarify the fact that it’s an ad. PR articles may not disguise their true nature. Information contained in the PR article must be concise, balanced, true, objective and duly complete to make sure that consumers can form their own opinion about the advertised products or services. The information may not be misleading by distorting, overemphasizing, or withholding facts.
In the case of sponsorship, the Sponsor or any other business named thereby must be published (indicated) so that all visitors of AI Hungary learn about the sponsorship.

5. Liability

5.1. Warranty
Advertiser warrants that the content of data, information and advertising material provided by them is true, does not breach third party rights (including copy rights, industrial property rights, trademarks, person-related rights), the relevant laws and authority regulations, is not subject to advertisement ban or limitation, so in particular it does not violate Act 2008 of XLVIII on the basic conditions and certain limitations of economic advertising activity, Act 2008 of XLVII on the ban of unfair anti-consumer trade practices and Act 2010 CLXXXV on media services and mass communications, Act 2010 of CIV on press freedom and the basic rules of media contents, nor regulations, guidelines, opinions of the National Media Authority (NMHH) and the provisions of the relevant industry code. Advertiser warrants that in case it is provided for by law or authority regulation, the ad provided by them contains all necessary warnings and information. Advertiser also acknowledges that only advertiser bears responsibility for the truth, content, statement, visual presentation of data and information provided by them, as well as for the rightfulness of warnings as applicable and the breach by the ad of the above-mentioned third party rights.

AI Hungary disclaims any right to use concerning items under legal protection used in the ad, and in the case of breach of person-related rights, for any other civil law claims as well.

5.2. Damage claim clause
In case the publication of the ad or the advertising material breaches any laws, leads to the violation of person-related rights or breaches or jeopardizes third party rights or rightful interests, and as a result the operator of AI Hungary faces a civil law suit, advertiser must pay all damages and costs (including compensations, torts, penalties, procedural fees, and litigation costs) to the Service Provider in question directly and without any delay. This provision applies to the case as well if any penalty imposed on the operator of AI Hungary or the enforcement of any other claims is due to the fact that advertiser has infringed its warranty obligations.

5.3. Liability for advertising material provided
Operator of AI Hungary does not check the advertising material provided from aspects related to copy right, media right, press or advertising ethics; any burden from damages arising therefrom as well as court or civil law claims are borne by advertiser. By accepting this information, advertiser expressly overtakes the payment related to penalties imposed on the operator of AI Hungary (in particular those by the National Media Authority (NMHH) and its organs), as well damage and civil law claims arising out of infringement of rules on copy right law, advertisement and media law, competition law and civil law regulations.

Advertiser irrevocably overtakes from the operator of AI Hungary as publisher of advertisements/electronic advertisements all penalties, damage payments, torts, costs and civil law claims arising out of violating its warranty obligations as well as originating from its joint liability with the publisher of the advertisement under Act 2008 of XLVIII on the basic conditions and certain limitations of economic advertising activity and Act 2008 of XLVII on the ban of unfair anti-consumer trade practices and its joint liability with the publisher of any electronic advertisements under Act 2001 of CVIII on certain matters concerning e-commerce services and services related to information society.

Under liabilities provided for in this chapter and based on take-over of liability and assumption of debt, advertiser is directly liable against the beneficiary, and it must pay all above-mentioned penalties, damage payments, torts and costs to the beneficiary at the time of maturity. In case advertiser cannot be held directly liable as provided for under the law, and the operator of AI Hungary was held liable or paid for claims, advertiser will be obliged to compensate the operator of AI Hungary unconditionally and without delay.

In the case of joint advertisement, the person posting the ad is liable for any further advertisements under the relevant liability rules. Advertiser warrants that it is entitled to order the ad on behalf of any other advertiser contained in the advertisement.

Advertiser is solely liable for the truthfulness of data provided thereby and the quality assurance declaration; furthermore, in case it infringes provisions on the ban of misleading of analogy-based advertising activities, with the exceptions provided for in Act 2008 of XLVIII on the basic conditions and certain limitations of economic advertising activity.

If called upon to do so by the authority in charge, advertiser is obliged to provide evidence to demonstrate the truthfulness of any statements forming part of the advertisement. If advertiser does not comply with this obligation, it must be deemed that the facts did not match reality. Advertiser is obliged to pay for all damages and related costs incurred by the operator of AI Hungary arising out of its failure to fulfil this lawful obligation.

Advertiser acknowledges and expressly accepts that it will not enforce any damage claims against web page AI Hungary with regard to the fact that the service is free of charge.
